How does this protect the Service Requester
The Service Requester is protected by the following:
- Funds deposited by the Service Requester are securely kept until they approve the deliverables, thus protecting them from poor quality work, whilst preserving the right of the Service Provider to be paid for work done.
- In addition, providing the tools and services supplied by e-service-expert.com for the purposes of managing the work - an adequate record of delivery is maintained and subject to peer review and oversight by e-service expert.com to ensure any quality issues are raised early on and addressed appropriately.
Thus the Service Requester can be assured of professional services and a an independent oversight of quality.
- Either-service-expert or the Service Requester can at any time request of the other that the transaction be terminated or altered by mutual agreement - ensuring that quality is maintained throughout the assignment.
In the event of an agreement to terminate e-service-expert.com will under the terms of its Contract of Service (lodged with the Escrow Agency) require pro rata payment for its service provider and at its own determination full transaction fees although at its own discretion make a fair and reasonable reimbursement of its transaction fees outside of the Escrow agreement.
How does this Protect the Service Provider
The Service Provider is protected by the following:
- As funds are deposited in advance of the work being done the Service Provider can be assured that adequate funds are available for the work that is to be undertaken
- At the time the Escrow is registered with Safe Kiwi, a Contract of Service detailing the precise payment details of the transaction are simultaneously lodged by e-service-expert.com.
This Contract of Service between the Service Provider and e-service-expert.com acts as the instructions for the disbursement of the funds once the funds have been approved for release.
In other words, the Contract of Service, shows how the deposited funds will be disbursed between the Service Provider (for the work done)and e-service-expert.com.(for their fees and transaction costs).
The Service Provider knows precisely what he will be paid before he starts work.
What happens if their is a dispute?- In the unlikely event of a dispute regarding the delivery of the services - there is a an efficient mediation service that must be entered into.
This process aims to ensure that the parties come to an agreement quickly and is governed by New Zealand law. e-service-expert.com will ensure that's its interests and those of the service provider are represented in this mediation process.
- In addition, providing e-service-expert.com's tools and services are used to manage the work and deliverables - there is full record of events and the ability to peer review the deliverables, adding strength to the claim that the services or deliverables provided were of sufficient quality to meet the stated requirements of the service requester.
In this way the Service Provider has the best case for justifying their claim for payment.
